By submitting the order electronically, the Buyer accepts the terms and conditions set out in these GTC as binding upon themselves.

2.3. Any general terms and conditions of the Buyer shall be void in relation to the legal relationship between the parties.

3. TERMS AND CONDITIONS FOR PURCHASES IN THE ONLINE SHOP, REGISTRATION

3.2. Purchases made in the online shop do not require registration; however, the Customer has the option to register in order to simplify the purchasing process and to subscribe to newsletters. You can register by clicking on the user account icon in the top right-hand corner and completing the registration form accurately. The Seller accepts no liability for any losses arising from the submission of incorrect or inaccurate details provided by the Buyer.

3.3. Once all fields on the registration form have been completed correctly, the Seller shall provide the Buyer with a password of their choice to access the online shop. Should the Buyer forget their password, the Seller will issue a new password upon request. The Seller accepts no liability for any damage arising from the disclosure or unauthorised use of the password.

4. SUBJECT MATTER OF THE CONTRACT

4.1. The subject matter of the contract concluded between the parties is the range of professional hair care products and accessories available for purchase in the online shop.

4.2. Detailed information on the key properties and characteristics of the products can be found on the relevant product information page or data sheet.

5. THE TECHNICAL STEPS INVOLVED IN CONCLUDING A CONTRACT, AND THE FORMATION OF THE CONTRACT

5.1. In the online shop, the Buyer may indicate to the Seller their intention to purchase products (their order) through conduct implying such an intention, as set out below.

5.2. In the online shop, the Customer can select the product type and variant (colour shade, packaging) on the product information page, and may specify the quantity to be ordered, which they can add to their basket by clicking the „Add to basket” button.

5.3. Once the Buyer has selected a product, they can click on the shopping basket icon in the top right-hand corner to view the list of products selected for purchase; they may view this list at any time and may amend the contents of the basket at any time before submitting the order. If the Customer wishes to add further products to the basket, they may continue shopping, change the quantity of a product they wish to purchase, or remove the product. If you select another product, change the quantity of a selected product, or remove a product, the contents of your basket will be updated automatically.

5.4. Once the products have been selected, the Customer must enter the details required for contact and delivery on the electronic form that opens when they click the „Proceed to Checkout” button, select the desired delivery method (Foxpost home delivery or parcel point), then select the preferred payment method (credit card, bank transfer), and finally provide the details required for invoicing (if the billing and delivery addresses differ)

5.5. Before submitting the order electronically, the Customer must check that the details they have entered are correct and correct any data entry errors. When completing the electronic forms, the software operating the website will indicate any missing or incorrectly entered data via an error message displayed in a pop-up window, thereby enabling the Customer to add or or to correct it.

5.6. Prior to submitting the order electronically, the Customer shall, by ticking the relevant box, declare that they have read the provisions set out in these General Terms and Conditions, understand them and accept them as binding upon themselves, and expressly acknowledge that submitting the order electronically entails a payment obligation to be fulfilled in favour of the Seller.

5.7. The Buyer may submit the order electronically to the Seller by clicking on the „Order with payment obligation” button. An order submitted electronically by the Buyer shall be deemed a legal declaration of intent to enter into a contract.

5.8. The Seller shall record the receipt of the order electronically and shall immediately send the Buyer an automatic confirmation by email, which shall contain the details of the recorded order. This notification merely confirms that processing of the order has commenced; however, it does not yet constitute acceptance of the order by the Seller, nor does it signify the formation of a contract. If the Buyer does not receive the confirmation within 48 hours of the order being placed, the Buyer’s obligation to purchase shall automatically lapse without any further conditions.

5.9. The Seller shall assess whether the order can be fulfilled and, if it accepts the order, shall send the Buyer confirmation of acceptance by email within 48 hours. The contract is concluded when the email confirming acceptance of the order becomes available to the Buyer.

5.10. Under the terms of the contract, the Seller is obliged to deliver the goods and the Buyer is obliged to pay the purchase price.

5.11. The Seller shall not be liable for any delay in delivery, error or failure to perform arising from information provided by the Buyer that is incorrect or inaccurate.

5.12. If the order contains false or incorrect information, or is incomplete, or if the product ordered runs out of stock after the order has been placed but before delivery, and the Seller is therefore unable to fulfil the order, the Seller reserves the right to withdraw from the contract. In this case, the Seller shall notify the Buyer of the withdrawal by email and, at the same time, shall arrange for the refund of the purchase price paid by the Buyer. In such a case, the Buyer may not assert any claim for damages or any other claim against the Seller arising from the failure to fulfil the contract.

5.13. The contract concluded between the parties shall not be deemed to be a written contract. The contract is deemed to be a contract concluded electronically, to which the provisions of Act CVIII of 2001 on certain aspects of electronic commerce services and information society services (hereinafter: „Ektv”) apply.

5.14. Apart from the electronic recording of the order and the electronic transmission of the confirmation, the Seller shall not file the contract concluded electronically. The Buyer may print out these General Terms and Conditions and the confirmation containing the details of the order on paper or save them to another durable medium, thereby ensuring that the contract concluded electronically remains accessible to them at a later date.

6. PURCHASE PRICE

6.1. The gross prices, inclusive of value added tax, are displayed alongside the products in the online shop. The prices shown are always in Hungarian forints. Any promotional prices for products are always shown separately. Promotional prices are always valid whilst stocks last or for the duration of the promotion.

6.2. The prices shown next to the products do not include delivery costs; the Seller shall inform the Buyer of these separately – depending on the chosen delivery method – before the order is placed.

6.3. The Seller reserves the right to change prices. Any such changes in the online shop shall take effect as soon as they appear on the website and shall not affect the purchase price of products that have already been ordered. Should an incorrect price appear on the online shop’s interface despite the Seller’s best efforts, with particular regard to prices that are obviously incorrect or appear due to a possible system error, the Seller shall not be obliged to supply the product at the incorrect price. In such cases, the Seller may offer to supply the product at the correct price, upon which the Buyer may withdraw from the purchase.

7. TERMS OF PAYMENT

7.1. Payment for the purchased products may be made – at the Buyer’s discretion – by credit card or bank transfer.

7.2 If the Buyer has any outstanding orders, the Seller is entitled to withhold fulfilment of any new order placed by the Buyer until the Buyer has met their payment obligations arising from the previous order.

7.3. Online credit card and other payment methods are processed via the Barion system. Credit card and other payment details are not disclosed to the merchant. Barion Payment Zrt., the provider of this service, is an institution supervised by the National Bank of Hungary; its licence number is H-EN-I-1064/2013.

7.4. During the transaction, you must provide the card number, the card’s expiry date and the 3-digit security code located on the signature strip on the back of the card. Once the transaction has been initiated, the card undergoes real-time authorisation, during which the card-issuing bank verifies the authenticity of the card details, as well as the available balance and spending limit. If the card details are found to be valid following this check, the bank will place a hold on the amount due on the card. Depending on the account-holding bank, the amount will be debited from your account within a few days.

7.5. The Seller shall not charge any additional fee for payment by bank card.

7.6. The Seller shall issue an invoice for the credit card payment and send a copy of it to the Buyer electronically (by email). The original copy of the invoice is included in the parcel sent to the Buyer.

8. DELIVERY, PACKAGING

8.1. The Seller shall arrange delivery using the services of the Foxpost-Packeta Group.

8.2. The delivery time undertaken by the Seller is generally 1–3 working days from the date of confirmation of acceptance of the order. The Seller shall notify the Buyer of the expected delivery time by email and shall also send the Buyer a tracking code, which the Buyer can use to track the progress of the parcel’s delivery on the courier service’s website.

8.3. If, for any reason, delivery cannot be made within the agreed delivery period, the Seller shall inform the Buyer of the expected duration of the delay.

8.4. The Seller shall not be liable for any delay in performance arising from external circumstances beyond its control which, at the time of confirmation of the order, could not have been foreseen even with due care, and which could not have been prevented or averted by taking reasonable measures.

8.5. Should any product ordered be out of stock or the requested quantity not be available, the Seller shall notify the Buyer of this as soon as possible. In such cases, the parties may agree to fulfil the order in instalments, or to arrange for a single delivery once the last of the ordered products has been received. In such cases, the delivery deadline shall depend on the date of receipt of the last product.

8.6. The products are packed by a member of the Seller’s staff; no separate charge is made for this.

8.7. The Customer is obliged, at the time of delivery, to check that the parcel is undamaged and that the details on the delivery note are correct, to sign the delivery note and to return it to the representative of the logistics partner carrying out the delivery.

8.8. Upon receipt, the Buyer is obliged to check the contents of the parcel to ensure they match the products listed on the invoice or as ordered. Should the Buyer notice any discrepancies, they must notify the Seller immediately. The Seller shall investigate the matter and, if necessary, arrange for a replacement. In such cases, the Seller’s logistics partner shall arrange for the return delivery. In the event of a fault in performance, the cost of redelivery shall be borne by the Seller.

8.9. The Buyer acknowledges that if they fail to collect the parcel within the specified time limit, the Seller shall be entitled to withdraw from the contract, provided that the Buyer is notified at the same time and the purchase price is refunded.

8.10. The Seller will only fulfil orders for delivery addresses located within Hungary; orders placed for destinations other than these will be rejected.

9. WITHDRAWAL

9.1. A Buyer who qualifies as a consumer is entitled to withdraw from the contract within 14 days without giving any reason, in accordance with the terms set out in Annex 1 to these General Terms and Conditions, by using the model declaration form set out in Annex 2 or by using the withdrawal function.

The withdrawal function is the online withdrawal form („withdrawal from the contract”) made available by the Seller on the website, in which the consumer may notify the business of their decision to withdraw from the contract by filling in the identification details of the order concerned; the Seller shall confirm receipt of this notification without delay.

9.2. If the consumer has withdrawn from the contract as set out above, they are obliged to return the product to the Seller without delay, but no later than 14 days from the date of notification of withdrawal. The return shall be deemed to have been made within the time limit if the consumer posts or hands over the product before the expiry of that time limit. The consumer shall bear only the direct costs of returning the product.

9.3. Where the right of withdrawal is exercised, the Seller shall refund the full purchase price of the product to the Buyer within 14 days of receiving the notice of withdrawal, including the delivery charge. The Seller may withhold the refund until it has received the goods back or until the Buyer has provided proof that they have been returned (whichever occurs first).

9.4. The Seller hereby states that the right of withdrawal as set out above applies only to a Buyer who is classified as a consumer in accordance with Section 8:1(3) of the Civil Code (Act V of 2013), namely a natural person acting outside the scope of their profession, self-employment or business activity, i.e. sole traders; business entities, other legal persons and organisations are not entitled to the right of withdrawal.

10.3. Until the quality complaint has been resolved, the Buyer is not entitled to use or resell the product, and is obliged to ensure that the Seller is able to inspect and examine the product in question.

10.4. Within 15 days of receiving the complaint, the Seller shall, depending on the nature and extent of the fault, make a proposal to resolve the complaint by means of repair, replacement or a price reduction. In the event of a replacement, the Buyer shall be obliged to return the product subject to the complaint to the Seller at the same time as taking delivery of the replacement product.

10.5. The Seller – as the distributor of the products – shall also be liable to the Buyer, who is a consumer, in accordance with the provisions of the Civil Code relating to product liability in the event of a defect in the product; on this basis, the consumer may require the Seller to rectify the defect in the product, or – if rectification is not possible within a reasonable time and without prejudice to the consumer’s interests – to replace the product.

10.6. The Seller does not provide the statutory warranty required by law for the products it sells.

11.3. The Seller provides several options for submitting a complaint, from which the complainant may choose; thus, complaints may be submitted by post, by telephone, electronically, in writing or verbally, or through an authorised representative.

11.4. Where a complaint is made verbally, the Seller shall investigate the verbal complaint – including those made by telephone – immediately and, where possible, remedy the matter.

11.5. If it is not possible to investigate the complaint immediately, or if the complainant does not agree with the way the complaint has been handled, the Seller shall draw up a report. In the case of a complaint made in person, a copy of the report shall be handed to the complainant; in the case of a verbal complaint made by telephone, it shall be sent to the complainant within 30 days, together with a reasoned response to the complaint.  The record shall contain at least the following:

  1. the complainant’s name, residential address, registered office and postal address,
  2. the place, time and manner of lodging the complaint,
  3. the Seller’s name and address,
  4. a detailed description of the complaint, setting out each element of the complaint separately, so that all the grounds for complaint set out in the complaint can be fully investigated,
  5. a description of the contract or product to which the complaint relates,
  6. a list of the papers, documents and other evidence submitted by the complainant,
  7. the place and time at which the minutes were drawn up,
  8. in the case of a verbal complaint made by telephone or via another electronic communications service, the complaint’s unique reference number, and
  9. in the case of a verbal complaint made in person, the signatures of the person taking the minutes and the complainant.
  1. In the case of complaints made by telephone, the complainant must be informed at the start of the conversation if the conversation is being recorded by the Salesperson, and, at the end of the conversation, the complainant must be informed of their right to listen to the audio recording of the conversation, or to be provided with a transcript or a copy of the audio recording, as well as the procedure for submitting a request for these.
  1. In the event of a written complaint, the Seller shall examine the substance of the complaint and shall send the complainant, within 30 days of the complaint being lodged, a written statement setting out its position on the complaint and its decision or action on the merits, together with a detailed explanation; to the complainant in writing within 30 days of the complaint being lodged. Upon request, the Seller shall also notify the complainant of the outcome of the investigation by telephone or email.
  1. It may be the case that, whilst investigating the complaint, the Seller requires further information from the complainant. In this case, it is in the complainant’s interest to respond to such a request as soon as possible, as the Seller cannot continue with the procedure until the missing information has been provided.
  1. When handling complaints, the complainant must be provided with a substantive, detailed response addressing all the objections set out in the complaint – as well as, where possible, any requests and questions relating to those objections. The response must be communicated in brief, simple and easily understandable language.

  1. If the complaint is rejected, the Seller shall inform the complainant in writing as to which body, authority or court the complainant may turn to with their complaint, depending on its nature. The complainant is entitled to these options even if the statutory 30-day response period prescribed for investigating the complaint has elapsed without a resolution.
  1. In the event that a complaint lodged by a complainant who qualifies as a consumer is rejected, or where the 30-day response period prescribed by law for investigating the complaint has elapsed without a resolution, any consumer dispute (in particular disputes relating to the conclusion and performance of a contract, as well as disputes concerning product quality, breach of contract and its legal consequences) may be referred to the competent Conciliation Board (an alternative dispute resolution forum) or to the court with jurisdiction and competence over the matter (judicial proceedings).
  1. As a general rule, the Conciliation Board within whose jurisdiction the consumer’s place of residence or abode is situated is authorised to investigate a consumer dispute; however, at the consumer’s request, another Conciliation Board specified in the consumer’s application may also have jurisdiction over the proceedings. The contact details of the Conciliation Boards are set out in Annex 4 to these General Terms and Conditions.
  1. The decision of the Conciliation Board is merely a recommendation to the Seller if, at the start of the proceedings, the Seller declares that it will not accept the Conciliation Board’s decision as binding. The Conciliation Board’s decision may become binding if, at the start of the proceedings or upon the announcement of the decision, the Seller acknowledges in a statement that the Conciliation Board’s decision is binding upon them (declaration of submission).
  1. A complainant who is a consumer may request that the form serving as the basis for proceedings before the Conciliation Board be sent to them if their complaint has been rejected or if the 30-day response period prescribed by law for investigating the complaint has elapsed without a resolution.
  1. If a Buyer who qualifies as a consumer has experienced any breach of consumer protection law on the part of the Seller, they may refer the matter to the consumer protection authority with jurisdiction over the Seller’s registered office, provided that they have first attempted to resolve the dispute with the Seller. Matters falling outside the remit of the consumer protection authority include disputes concerning the formation, validity, its legal effects and its termination, nor does it cover disputes relating to the determination of a breach of contract and its legal consequences; in order to resolve such disputes, the consumer may initiate proceedings before a conciliation body or bring the matter before a court. INFORMATION ON WARRANTY OF FITNESS FOR PURPOSE, PRODUCT WARRANTY AND GUARANTEE

(in accordance with Government Decree No. 45/2014 (26 February))

1. Warranty of fitness for purpose

In what circumstances can you exercise your right to a warranty for defects?

In the event of a breach of contract by the Seller, you may make a claim under the warranty against the business in accordance with the provisions of the Civil Code.

What rights do you have under your warranty claim?

You may, at your discretion, make a claim under the warranty for defects as follows:

You may request a repair or a replacement, unless the fulfilment of the option you have chosen is impossible or would entail disproportionate additional costs for the business compared with the fulfilment of any other option. If you have not requested, or were unable to request, a repair or replacement, you may claim a proportionate reduction in the price, or you may repair the fault yourself or have it repaired by a third party at the trader’s expense, or – as a last resort – you may also withdraw from the contract. In the case of a contract between a consumer and a trader – for the sale of goods classified as movable property, the supply of digital content or the provision of digital services – you may not, in exercising your rights under the warranty of quality, rectify the defect yourself at the trader’s expense, nor may you have it rectified by a third party. You may switch from one warranty right you have chosen to another, but you shall bear the cost of such a switch, unless it was justified or the trader gave cause for it.

Within what time limit can you make a claim under the warranty for defects?

You are obliged to report the defect immediately upon discovery, but no later than two months from the date of discovery. However, please note that you may no longer enforce your warranty rights once the two-year limitation period from the date of performance of the contract has expired. In the case of second-hand goods, this period is one year.

Against whom can you make a claim under the warranty for defects?

You may make a claim under the warranty of quality against the Seller.

What other conditions apply to the enforcement of your rights under the warranty?

Within one year of performance, there are no conditions other than notifying the Seller of the defect for you to enforce a claim under the warranty of quality, provided you can prove that the product or service was supplied by the Seller. However, once one year has elapsed since performance, you are obliged to prove that the defect you have identified was already present at the time of performance.

2. Product warranty

In what circumstances can you exercise your right under the product warranty?

In the event of a fault with a movable item (product), you may, at your discretion, exercise the right set out in point 1 or make a claim under the product warranty.

What rights do you have under the product warranty?

Under the product warranty, you may only request that the faulty product be repaired or replaced.

In what circumstances is a product considered to be faulty?

A product is considered defective if it does not comply with the quality requirements in force at the time it was placed on the market, or if it does not possess the characteristics specified in the manufacturer’s description.

Within what timeframe can you make a claim under the product warranty?

You may make a claim under the product warranty within two years of the product being placed on the market by the manufacturer. Once this period has expired, you will lose this right.

Against whom, and under what other conditions, can you make a claim under the product warranty?

You may only make a claim under the product warranty against the manufacturer or distributor of the movable property. Should you wish to make a claim under the product warranty, you must prove that the product is faulty.

In what circumstances is the manufacturer (distributor) exempt from their product liability obligations?

The manufacturer (distributor) is only exempt from its product liability obligations if it can prove that:

  • the product was not manufactured or placed on the market in the course of their business, or
  • the fault could not have been detected at the time of placing the product on the market, given the state of the art in science and technology, or
  • the defect in the product arises from the application of legislation or mandatory regulatory requirements. The manufacturer (distributor) need only prove one ground for exemption.

Please note that you cannot assert a claim under the warranty for defects in materials and a claim under the warranty for defects in workmanship simultaneously or in parallel on the basis of the same fault. However, if your claim under the product warranty is successfully upheld, you may then make a claim under the warranty for defects against the manufacturer in respect of the replaced product or the repaired part.

3. Warranty

In what circumstances can you exercise your right under the guarantee?

In the event of defective performance, the Seller is obliged under the contract to provide the statutory warranty required by law; however, the Seller also provides a 12-month voluntary warranty on the products.

What rights do you have under the warranty, and within what timeframe? You may request that the faulty product be repaired or replaced.

When is a business released from its warranty obligations?

The business is only exempt from its warranty obligations if it can prove that the defect arose after performance.

Please note that you may not assert claims under the warranty for defects and the guarantee, or claims under the product warranty and the guarantee, simultaneously or in parallel on the basis of the same fault; however, you are entitled to the rights arising from the warranty independently of the entitlements set out in points 1 and 2.
